Module Scope
The Interactive Gambling Module for Australia provides organisations with a structured overview of their legal obligations concerning interactive or online gambling services as regulated under federal, state and territory laws. This module assists gambling operators in understanding, navigating, and maintaining compliance with applicable laws, ensuring their services adhere to responsible gambling practices, licensing requirements, and consumer protection standards.
Interactive gambling services encompass games of chance, betting on sports or racing events, lotteries, and other wagering services delivered through online platforms. These services are subject to both Commonwealth and state/territory regulations.
The Interactive Gambling Module addresses the following topics:
- Prohibition of Certain Interactive Gambling Services:
- Operators must not offer prohibited services such as online casino gaming, instant or scratch lotteries, or online in-play betting for sporting events.
- Services provided must adhere to the licensing requirements of relevant state or territory regulators.
- Licensing and Registration:
- Operators must obtain the necessary licences, permits, or approvals for each jurisdiction in which they operate. Licensing processes vary across Australian states and territories and cover activities such as race bookmaking, sports betting, lotteries, and betting exchanges.
- Consumer Protection Measures:
- Operators must implement responsible gambling practices and adhere to consumer protection frameworks, including the National Consumer Protection Framework for Online Wagering.
- Self-Exclusion and Advertising Restrictions:
- Operators must comply with BetStop (National Self-Exclusion Register) requirements and adhere to strict advertising and promotional guidelines to prevent inducement to gambling without consent.
- Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF):
- As reporting entities, operators must adopt and maintain AML/CTF programs, conduct customer identification and verification procedures, and comply with reporting obligations to AUSTRAC.
- Financial Reporting and Record-Keeping:
- Operators must prepare and submit financial reports and retain gambling records as mandated by state/territory regulators.
The Interactive Gambling Module addresses the following key legislative sources:
- Interactive Gambling Act 2001 (Cth)
- State/Territory Licensing Acts and Regulations
- Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
- Privacy Act 1988 (Cth)
- Broadcasting Services Act 1992 (Cth)
The module also covers in detail, the consequences of non-compliance, which may result in penalties such as:
- Pecuniary and Criminal Penalties: Including imprisonment and significant fines.
- Licence Revocation or Suspension: State or territory regulators may cancel or suspend operating licences.
- Investigations by the ACMA: The Australian Communications and Media Authority (ACMA) may investigate alleged breaches and issue warnings, infringement notices, or seek civil remedies.
The module covers all legislated Commonwealth and state/territory legal obligations of Australian organisations and demonstrates practical assistance and guidance to ensure that these obligations are complied with through the implementation and maintenance of best
practice processes throughout the organisation. The module does not cover the role or actions to be taken by consumers in the event of a breach of regulations or obligations by an organisation.
