Module Application
The Competition & Consumer Protection module addresses the Indian legal and regulatory obligations that affect how organisations compete, transact, supply goods and services, engage with consumers, advertise, communicate commercially and operate in certain regulated sectors. Its application depends on the organisation’s activities, products, market position, business model, customers, transactions and regulatory status.
The module reflects the Indian competition, consumer protection and product-regulation landscape, together with sector-specific requirements relevant to IFSC-regulated entities and cable television operators. It also addresses circumstances in which conduct or transactions outside India may be subject to Indian competition requirements because of their effect on the Indian market, and where an e-commerce entity outside India systematically offers goods or services to Indian consumers.
The Competition & Consumer Protection module provides information to organisations about how to comply with legal responsibilities when dealing with the following:
- Competition-sensitive commercial arrangements, market conduct and acquisitions or other transactions affecting competition;
- Competition authority investigations, information requests, orders and enforcement proceedings;
- Fair trading, consumer disclosures, e-commerce and direct-selling activities;
- Consumer complaints, Consumer Commission proceedings, appeals, revisions and mediation;
- Advertising claims, endorsements, promotional activity and environmental claims;
- Commercial communications sent through Indian telecom networks;
- Packaged commodities, weights and measures, product conformity and compulsory standards;
- Consumer and client dealings by IFSC-regulated entities, and cable television network operations.
The Competition & Consumer Protection module also comprehensively covers requirements arising under key Indian frameworks, including:
- Indian competition law and the Competition Commission of India framework;
- Consumer protection, e-commerce, direct selling and consumer dispute-resolution frameworks;
- Advertising, endorsement and cable advertising standards;
- Telecom commercial communications requirements;
- Legal metrology, Bureau of Indian Standards certification and compulsory quality-control requirements;
- The International Financial Services Centres Authority framework for consumer and client protection;
- The cable television network regulatory framework.
The module applies to organisations operating in India or undertaking activities that affect Indian markets or consumers. Some requirements can apply beyond India where the relevant Indian connection is established. Applicability is determined by the organisation’s role and the nature of its activities.
The Competition & Consumer Protection module should be subscribed to by any organisation that:
- Enters into commercial arrangements, distributes goods or services, or may hold market power in India;
- Proposes an acquisition, merger, amalgamation, joint venture or other transaction affecting India;
- Sells goods or provides services to consumers, including through e-commerce or direct-selling channels;
- Advertises, promotes or endorses goods or services in India;
- Sends or authorises commercial communications through Indian telecom networks;
- Manufactures, packs, imports, distributes or sells regulated products, packaged commodities, weights or measures;
- Deals in products subject to compulsory BIS certification or quality-control requirements;
- Is regulated by the IFSCA and operates in an IFSC or operates a cable television network.
The specific questions and answers covered by the module include:
- How an organisation can assess whether its commercial arrangements or market conduct raise competition concerns;
- How an organisation can address competition requirements during acquisitions and other transactions;
- How an organisation can respond to competition authority inquiries and proceedings;
- How an organisation can meet fair-trading and consumer-facing responsibilities across sales, e-commerce and direct-selling activities;
- How an organisation can address consumer complaints, disputes and Consumer Commission proceedings;
- How an organisation can ensure that advertising, endorsements and commercial communications meet applicable requirements;
- How an organisation can meet applicable product-labelling, measurement, certification and conformity responsibilities;
- How an IFSC-regulated entity or cable operator can meet its applicable consumer, client and operational responsibilities.
The module addresses the compliance lifecycle from commercial activity and consumer engagement through regulatory inquiries, dispute resolution and enforcement. The inputs also identify potentially significant consequences of non-compliance, including directions to discontinue or modify conduct, monetary penalties, recall or reimbursement orders, restrictions on telecom resources, product-related enforcement, registration consequences, and regulatory or criminal action for specified contraventions.
The Competition & Consumer Protection module supports organisations in understanding and addressing the Indian legal responsibilities that apply to their competitive conduct, consumer-facing activities, products, communications and relevant sector-specific operations.
